Terms and Conditions

These Terms and Conditions ("Terms") form a binding agreement between you ("User," "you," or "your") and Fribee ("Company," "we," "us," or "our") governing your access to and use of the Fribee website, application, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

You must be at least 13 years old to create an account or use the Service. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction, if lower), you may only use the Service under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate, current, and complete.

To access certain features of the Service, you must create an account and provide certain personal information, which may include your name, phone number, email address, and other contact details ("Contact Information"). You agree to:

• Provide accurate, current, and complete information during registration and keep it up to date;
• Maintain the confidentiality of your account credentials and notify us promptly of any unauthorized use of your account;
• Accept responsibility for all activity that occurs under your account.

By registering for an account, you consent to Fribee collecting and storing your Contact Information and other account data in our databases, as further described in Section 5 (Data Collection and Storage) and in our Privacy Policy.

As part of the account creation process, Fribee uses your phone number to send a one-time SMS verification code ("Verification Code") for the sole purpose of confirming your identity and completing account registration. By providing your phone number and requesting a Verification Code, you expressly consent to receive this one-time automated text message from or on behalf of Fribee.

• Purpose: Verification Codes are used exclusively for account creation and identity verification. They are not used for marketing, promotional, or any other purpose.
• Message frequency: You will receive a single Verification Code message per verification attempt. Message frequency may vary if you request a new code.
• Message and data rates: Standard message and data rates charged by your mobile carrier may apply.
• Consent: Consent to receive a Verification Code is required in order to complete account creation, as it is necessary to verify your identity and secure your account.
• Carrier liability: Carriers are not liable for delayed or undelivered messages.

You acknowledge and agree that Fribee collects, processes, and stores certain information in connection with your use of the Service, including but not limited to:

• Contact Information (such as name, phone number, and email address);
• Account credentials and verification status (such as whether your phone number has been verified via SMS);
• Usage data and other information generated through your interaction with the Service.

This information is stored in Fribee's databases and used to operate, maintain, secure, and improve the Service, to communicate with you, and to comply with applicable legal obligations. We implement reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, alteration, or destruction. Further details regarding how we collect, use, share, and retain your information are set out in our Privacy Policy, which is incorporated into these Terms by reference.

You agree not to:

• Provide false, misleading, or another person's Contact Information without authorization;
• Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law;
• Attempt to gain unauthorized access to any accounts, systems, or networks connected to the Service;
• Interfere with or disrupt the integrity or performance of the Service, including the SMS verification system.

The Service, including all content, features, trademarks, and logos (including the Fribee name and logo), is owned by Fribee or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties, or for any other reason at our discretion. You may stop using the Service and request deletion of your account at any time by contacting us at Fribee@sera.dev.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, INCLUDING SMS VERIFICATION DELIVERY, WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, Fribee AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DELAY OR FAILURE IN DELIVERING SMS VERIFICATION CODES.

You agree to indemnify and hold harmless Fribee and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas, and you consent to personal jurisdiction and venue in those courts.

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after such changes become effective constitutes your acceptance of the revised Terms.
